Terms and Conditions


The present terms and conditions (hereinafter also referred to as “Terms” ) are applicable for all legal relations, products
("Products") offers, sales and deliveries between the customers ( “Customer”) and the owner of the online store www.babiana.com ("Vendor" )  run by OÜ TurtleTu (reg. code 14914502 ), located at Saare maakond, Saaremaa vald, Kavandi küla, Uus-Andruse, 94655 .


The validity of the contract of sale, product and price information


The conditions of sale apply to purchases of goods from the Vendor. The prices of the products sold in the online store are indicated next to the products. All the prices are in euros. A fee for shipping is added to the price. The shipping cost depends on the location of the Customer and the shipping method. The shipping cost is displayed when the Customer places the order. Product information is provided immediately adjacent to the product in the online store.

Placing an order

Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid as direct payment via bank transfer to the Vendor’s account:

By clicking on "Complete order", Customer completes the order and expresses unconditional acceptance of the present Terms and Conditions.

The contract enters into force when the amount payable is transferred to the bank account of the Vendor. If the Vendor cannot deliver the ordered goods due to stock running out or for any other reason, the Customer will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.


Shipment

The Vendor ships worldwide with a regular recorded post. The Customer bears the shipping cost and the respective price information is displayed next to the shipping method. All shipments within Estonia generally arrive at the destination specified by the Customer within 3-7 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia is guaranteed to arrive within calendar days. We have the right to ship goods in up to 45 calendar days in exceptional cases. Right of withdrawal

After receiving the order, the Customer has the right to withdraw from the contract entered into with the Vendor within 14 days. The right of withdrawal does not apply if the Customer is a legal person. To exercise the 14-day right of withdrawal, Customer must not use the ordered Products in any way other then is necessary to ensure the nature, characteristics and functioning of the Products in the same the way you would be allowed to test the Products in an actual store. If the Products have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the Products, or if there are any signs of use or wear and tear, the Vendor has the right to lower the amount returned by the decrease in the value of the Products. If for some reason Customer is not satisfied with the purchased Product, Customer has the right to return it in 14 days by sending a corresponding message to the e-mail address studiobabiana@gmail.com. 

The Client shall bear the cost of returning the Products, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective Product). The Client must return the Products within 14 days of the submission of the email of withdrawal or submit evidence that they handed over the Products to the carrier within the aforementioned period. Upon receiving the returned Products, the Vendor shall return to the Customer, immediately but no later than after 14 days, all of the payments received from the Customer based on the contract. The Vendor has the right to refuse to make the refund until the Products being returned are received or until the Customer has provided proof of returning the Products, whichever occurs first. If the Customer has chosen a different form of shipment than the cheapest usual form of shipment offered by the Vendor, the store is not required to compensate for the cost exceeding the usual shipping cost. The Vendor has the right to withdraw from the sale and demand that the Products be returned by the Customer, if the marked price of the Products in the online store is significantly lower than the market price of the Products due to an error.


Defective goods

The Vendor is responsible for the non-compliance of Products sold to a Customer with the Terms of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the Products to the Customer. Within the first six months of delivery, it is assumed that the defect was present at the time of delivery. It is the Vendor´s responsibility to prove otherwise. The Customer has the right to turn to the Vendor within two months of the occurrence of a defect by e-mailing. The Vendor is not liable for any defects arising after delivering the Products to the Customer. If Products bought from the Vendor have defects for which the Vendor is responsible, the Vendor will repair or replace the defective Products. If the Products cannot be repaired or replaced, the Vendor shall return to the Customer all of the payments involved in the contract of sale. The Vendor will respond to the consumer´s complaint in written form or in a form that enables written reproduction within 15 days.

Direct marketing and processing of personal data

The Vendor only uses the personal data entered by the Customer (including name, phone number, address, e-mail and bank details) for processing the order and sending Products to the Customer. The Vendor forwards personal data to the transport service provider to deliver the Products. We use SSL (Secure Sockets Layer) technology - the highest standard in online encryption technology - to ensure that your personal information remains secure. It encrypts all of your personal information, including name, and address so that it cannot be read as the information travels over the Internet. SSL encryption allows you to shop with confidence, knowing that only you and we have the ability to access your information. The Vendor sends newsletters and offers to the Customer's e-mail address only if the Customer has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail. The Customer can opt-out of offers and newsletters sent to their e-mail address at any time by letting Vendor to know via e-mail or by following the instructions in an e-mail containing an offer.

Settlement of disputes

All complaints made by a Customer about the Vendor must be e-mailed to studiobabiana@gmail.com. If the Customer and the Vendor are not able to settle the dispute by agreement, the Customer may contact the Consumer Dispute Committee or Harju Maakohus (Harju County Court) to protect their rights. Customer can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a Customer and the Vendor. Resolution of disputes by the Consumer Dispute Committee is free of charge for the Customer. A Customer may also turn to the dispute resolution bodies of the European Union.
